Welcome to Formflow! These Terms of Service (“Terms”) govern your use of our website, apps, and services (collectively, the “Services”). By using Formflow, you agree to these Terms. If you do not agree, please do not use our Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your country) to use our Services.
By creating an account, you confirm that the information you provide is accurate and complete.
2. Accounts
You are responsible for maintaining the security of your account and password.
You must notify us immediately of any unauthorized use of your account.
Formflow is not liable for any loss or damage caused by failing to keep your account secure.
3. Use of Services
You agree to use Formflow only for lawful purposes and in accordance with these Terms. You must not:
Copy, resell, or redistribute our Services without permission.
Upload or share unlawful, harmful, or misleading content.
Interfere with or disrupt the security, availability, or performance of the Services.
4. Subscriptions & Payments
Some features of Formflow require a paid subscription.
By subscribing, you agree to pay all applicable fees as described at checkout.
Fees are non-refundable except where required by law.
We may change pricing at any time, but changes will not affect your current billing cycle.
5. Intellectual Property
All content, designs, and software on Formflow are owned by us or our licensors.
You retain ownership of the content you create using Formflow, but grant us a limited license to host, display, and process it as needed to provide the Services.
6. Termination
We may suspend or terminate your account if:
You breach these Terms.
Your use of the Services risks harm to us or other users.
Required by law.
You may stop using Formflow at any time by deleting your account.
7. Disclaimers
Formflow is provided “as is” and “as available.”
We make no warranties that the Services will be uninterrupted, error-free, or fit for your specific purpose.
8. Limitation of Liability
To the maximum extent permitted by law:
Formflow shall not be liable for any indirect, incidental, or consequential damages.
Our total liability for any claim will not exceed the amount you paid to us in the 12 months before the claim arose.
9. Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with an updated “Last updated” date. By continuing to use our Services, you accept the revised Terms.
10. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of laws principles.
11. Submissions (Definitions, Counting Rules, and Limits)
What counts as a “Submission.”
A “Submission” is recorded the first time a visitor reaches twenty-five percent (25%) completion of a form or flow. Completion is measured against the required steps/fields on the visitor’s actual path (including any conditional logic); optional fields are excluded from the denominator. If a visitor completes the form and clicks “submit,” that also counts as one Submission (if not already counted at 25%).

13. SMS & text message communications
13.1 SMS program description
Formflow may offer SMS and text message communications to users, customers, subscribers, and prospective customers who choose to opt in.
By opting in, you agree to receive SMS messages from Formflow at the mobile number you provide. These messages may include transactional, informational, service related, account related, promotional, marketing, abandoned subscription, abandoned checkout, abandoned signup, upgrade reminder, incentive related, and support related messages.
Messages may relate to your Formflow account, your use of the Formflow platform, your subscription, your form activity, your submission usage, your plan, product updates, offers, incentives, reminders, or other Formflow services.
Formflow may operate more than one SMS program. These may include:
(a) transactional and service related SMS alerts, such as form submission alerts, lead notifications, account notices, system alerts, and other messages related to a user’s use of the Formflow platform; and
(b) marketing and promotional SMS messages, such as product updates, offers, incentives, bonus submission related messages, abandoned subscription or checkout reminders, upgrade reminders, and other promotional messages.
Consent for one SMS program does not automatically mean consent for every SMS program. Where required, Formflow may request separate consent for transactional/service related SMS messages and marketing/promotional SMS messages.
13.2 Consent to receive SMS messages
SMS communications are optional. Consent to receive SMS messages is not a condition of purchasing any property, goods, or services from Formflow, and it is not required to use Formflow’s core services.
By entering your mobile number and completing an SMS opt-in action, such as checking an unchecked consent box, submitting an SMS signup form, confirming a double opt-in message, texting a keyword, clicking an SMS consent button, or otherwise expressly agreeing to receive SMS messages from Formflow, you authorize Formflow to send SMS messages to the mobile number you provided.
These messages may be sent using automated technology, including an automatic telephone dialing system or similar messaging technology, where permitted by applicable law.
Providing a mobile phone number alone does not constitute consent to receive SMS messages. SMS consent must be given through an affirmative opt-in action.
13.3 Marketing and promotional SMS messages
If you opt in to receive SMS messages from Formflow, you may receive marketing and promotional text messages. These may include offers, discounts, product updates, reminders, upgrade prompts, usage related messages, bonus submission related messages, incentive messages, and other promotional communications relating to Formflow.
You understand that promotional SMS messages may encourage the purchase, renewal, upgrade, or continued use of Formflow products or services.
Where required by law, Formflow will obtain prior express written consent before sending marketing or promotional SMS messages. Under United States FCC rules, prior express written consent for marketing messages must clearly authorize the seller to send advertisements or telemarketing messages using automated technology, and must disclose that consent is not required as a condition of purchase.
13.4 Abandoned subscription, checkout, and signup reminders
Formflow may send SMS reminders relating to abandoned subscriptions, abandoned checkouts, abandoned signups, incomplete upgrades, incomplete registrations, incomplete payments, or similar incomplete actions.
These reminders may be based on your interaction with Formflow’s website or platform, including when you visit or begin a signup page, pricing page, checkout page, subscription page, upgrade page, payment page, or similar conversion page and do not complete the relevant action.
Formflow may use cookies, tracking pixels, scripts, analytics tools, plugins, and similar technologies to identify these incomplete actions and determine when to send reminder messages.
You will only receive abandoned subscription, checkout, signup, or upgrade reminder SMS messages where you have provided the required SMS consent.
For SMS messages relating to abandoned subscriptions, checkouts, signups, or similar incomplete actions, Formflow applies appropriate safeguards where required, which may include confirming consent through a double opt-in process, limiting the number of reminder messages sent, ensuring messages are sent within a reasonable time following the triggering event, and providing clear disclosures in our Privacy Policy and Terms of Service.
13.5 SMS subscriber incentives and bonus submissions
Formflow may offer optional incentives to users who opt in to receive SMS messages. These incentives may include additional monthly submission allowances, bonus submissions, discounts, promotional benefits, feature access, or other usage based benefits.
For example, Formflow may offer bonus monthly submissions to users who subscribe to SMS messages and remain subscribed.
Participation in SMS incentive programs is voluntary. If you unsubscribe from SMS messages, withdraw SMS consent, or otherwise become ineligible for the SMS incentive, Formflow may remove or discontinue the associated bonus submissions, incentive, promotional benefit, or usage based benefit.
Removing an SMS based incentive does not prevent you from using Formflow’s core services. It only removes the additional benefit that was offered in connection with SMS participation.
13.6 Message frequency
Message frequency varies. The number of SMS messages you receive may depend on your account activity, form activity, subscription status, submission usage, plan, participation in promotions or incentives, interaction with Formflow’s website or platform, and the SMS programs you have opted into.
Formflow does not guarantee any specific message frequency.
13.7 Message and data rates
Message and data rates may apply. Your mobile carrier may charge you for SMS messages or data usage according to your mobile plan.
Formflow is not responsible for charges imposed by your mobile carrier.
SMS message delivery is subject to carrier availability, network availability, device compatibility, and other factors outside Formflow’s control. Formflow does not guarantee that SMS messages will be delivered, delivered on time, or remain available on your device.
13.8 Opting out
You may opt out of SMS messages at any time.
To stop receiving SMS messages from Formflow, reply STOP to any SMS message from Formflow. You may also use any unsubscribe link provided in a message, update your SMS preferences inside your Formflow account where available, or contact us at [email protected].
After you opt out, Formflow will stop sending SMS messages to the opted out number, except that we may send a one time confirmation message confirming your opt-out request.
United States FCC rules recognize several reasonable opt-out methods for calls or text messages, including replying with words such as “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel,” or “unsubscribe.” The rules also state that revocation requests must be honored within a reasonable time not to exceed ten business days.
If you opt out of SMS messages, you may lose any SMS based incentive, bonus submission allowance, promotional benefit, or similar benefit that required an active SMS subscription.
Opting out of SMS messages does not automatically unsubscribe you from email communications. You must separately unsubscribe from email communications where applicable.

You may reply HELP to any SMS message from Formflow for help or support information.

13.10 No third-party sharing of SMS opt-in data
Formflow does not sell, rent, disclose, transfer, or share SMS opt-in data, SMS consent records, or text messaging consent status with third parties or affiliates for their own marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties for marketing purposes.
This includes your mobile phone number, SMS opt-in status, SMS consent records, opt-in timestamps, opt-in source, opt-out status, and any records showing that you consented to receive SMS messages from Formflow.
This commitment applies even if other sections of these Terms or our Privacy Policy describe circumstances where Formflow may share personal information with service providers, business partners, affiliates, successors, or other third parties.
13.11 Limited disclosures for SMS delivery and compliance
Formflow may disclose mobile phone numbers and SMS related data to service providers strictly as needed to operate the SMS program. This may include telecommunications carriers, SMS delivery providers, messaging platforms, compliance vendors, analytics providers, customer support tools, and infrastructure providers.
These providers may process SMS related data only as needed to deliver messages, manage consent, process opt-outs, maintain compliance records, prevent fraud or abuse, troubleshoot delivery issues, or operate the Formflow service.
Formflow does not authorize these service providers to use SMS opt-in data or SMS consent records for their own independent marketing purposes.
Formflow may also disclose SMS related data where required to comply with applicable law, regulation, subpoena, court order, lawful government request, carrier requirement, messaging provider requirement, or legal process.
13.12 Privacy
Your mobile number, SMS consent data, SMS opt-in data, SMS opt-out data, SMS message data, and SMS related records are handled in accordance with Formflow’s Privacy Policy, available at:

We collect mobile phone numbers only where users choose to provide them and consent to receive SMS communications. We use these phone numbers to send transactional, service-related, and, where consent is provided, marketing or promotional messages. We do not sell or share mobile phone numbers or SMS opt-in data with third parties for their own marketing purposes. Where applicable, we may use cookies, tracking pixels, scripts, analytics tools, plugins, or similar technologies to understand user activity and determine when to send relevant communications, including abandoned subscription, checkout, signup, or upgrade reminder messages.
13.13 Changes to SMS terms
Formflow may modify, suspend, or terminate its SMS program, SMS incentives, bonus submission offers, message types, or SMS related features at any time, subject to applicable law.
Formflow may update these SMS Terms from time to time. Updates will be posted on this page with an updated “Last updated” date. Your continued participation in the SMS program after the updated Terms are posted means you accept the updated SMS Terms.
